2. Preliminary Information

The General Terms of Purchase govern the distance-selling relationship between the products offered by Tattoox on its website https://shop.tattoox.com and the User, in accordance with the legislation in force on distance selling, the General Law for the Protection of Consumers and Users, data protection, and Information Society Services and Electronic Commerce.

3. Conclusion of the Contract

You must register as a user of the website to purchase online. To do so, you can access the "User Registration" section.

Likewise, the User declares that they have sufficient legal capacity to contract the products on the Website.

During the purchase process, you must identify yourself with the username and password provided. This data will not be public. You are responsible for handling the username and password obtained during registration as a User confidentially and responsibly, and you may not transfer them to anyone else. 5. Product Availability

The availability of the products offered by Tattoox may vary according to user demand. Although Tattoox updates stock periodically, the product requested by the User may be out of stock at that time. In the event of non-performance due to unavailability, the User will receive an informative email and, within a maximum of 30 days, the amounts paid for the canceled order will be refunded.

 

6. Price

The price of each product will be the one shown in euros alongside each product on the Website and will include the applicable VAT which, in this case, is 21%.

Tattoox reserves the right to modify its prices at any time and without prior notice. The price applicable to the purchase request made by the User will be the one recorded at the time of accepting the General Terms of Purchase.

 

7. Payment Method

The User may pay the amount of their order by choosing any of the following methods. During the purchase process you must indicate your choice:

a) VISA or MASTERCARD credit card

All personal or banking data transmission operations are carried out in a secure environment, a server based on standard SSL (Secure Socket Layer) security technology. All the information you transmit travels encrypted over the network.

Likewise, your credit card details are entered directly on the bank’s website, in the bank’s POS (Point of Sale Terminal), and are neither entered nor stored on any Tattoox server.

When paying with a VISA or MASTERCARD card, you will always be asked for the following information: the card number, the expiration date and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD card, thus offering greater guarantees regarding the security of the transaction.

When the amount of a purchase has been charged fraudulently or improperly using a payment card number, the holder may demand the immediate cancellation of the charge. In this case, the corresponding debit and re-credit entries in the provider’s and the holder’s accounts will be made as soon as possible. However, if the purchase had actually been made by the cardholder and the refund request was not the result of exercising the right of withdrawal or termination, and therefore the holder had improperly requested the cancellation of the corresponding charge, they will remain liable to Tattoox to compensate for the damages caused as a result of such cancellation.

8. Shipping Costs

All shipping costs are detailed on the shipping and returns page.

    Execution and Delivery Times

    Tattoox will ship products to the Iberian Peninsula, Balearic Islands, Canary Islands, countries of the European Union, as well as to other countries.

    Once the User has paid for the product, Tattoox has confirmed it, and the confirmation email has been sent to the User regarding their purchase, the products will be delivered.

    Delivery of the order will be made to the address that the User has specified during the purchase process on the website -a P.O. box or a post office will not be valid as an address- and under no circumstances will a change of address be accepted. accepted. Once the order has been shipped.

    Tattoox will not be responsible for errors that may occur in the delivery of purchased products if the User has not correctly completed the delivery address.

    For orders placed within the peninsula (Spain and Portugal) delivery times are 24 to 48 hours on business days. This period does not include Sundays or public holidays.

    If there is any issue with the delivery timeframe, Tattoox will inform the User promptly and appropriately. The User should bear in mind that:

      • No home deliveries are made on Saturdays, Sundays and public holidays.
      • Deliveries are 24 to 48 business hours; therefore, there are no deliveries or shipments on Sundays and public holidays. If you purchased with a 2x1 promotion or similar, your order may take a little longer, never exceeding 72 business hours.
      • If you have purchased a pre-order product together with another regular product, all will be shipped together within the timeframe set on the same pre-order product page.
      • For orders placed to the Balearic Islands, delivery times are 48 to 72 business hours.
      • For orders placed to the rest of the European Union, delivery times are 1 to 7 business days. This period does not include Saturdays, Sundays or public holidays.
      • For orders to the rest of the world, delivery times are 5 to 10 business days. This period does not include Saturdays, Sundays or public holidays.

        If you need to adjust shipping to your preferred time slot, simply send an email to info@tattoox.io immediately after making the purchase. In the email, you may indicate whether you want the order delivered in the morning (8:30-14:00h) or in the afternoon (14:00h-20:00h), Monday to Friday. This option is only valid for purchases made in the Iberian Peninsula.

        If you are absent at the time of delivery, the carrier will attempt a second time, and if you are still absent on the second attempt, they will contact you via SMS, phone call or the contact email provided in the order to arrange a delivery or to collect the package at the nearest transport agency that makes the delivery.

      9. Order Tracking

      Once the order has been shipped, the User will automatically receive an email or SMS with the tracking link to know the status of their order at all times.       10. Failed Shipments

      Tattoox offers free peninsular shipping within 24 working hours, with up to two delivery attempts at no cost.

      If delivery is refused or unjustifiably delayed, we reserve the right to charge you the resulting storage costs and/or to terminate the contract. If so, we will pay in the difference between the amount already paid and the reasonable administrative costs incurred (including the failed delivery and the return of the Order, in addition to storage costs).

       

      11. Withdrawal

      The User will have the right to withdraw from the contract, without any penalty, within fourteen (14) calendar days from the date of receipt of the product.

      To proceed with the return, the product must not have been used and must be in perfect condition with the labels and corresponding packaging (boxes, bags, etc.) as received, to the following address: Calle d'Àlaba, número 61, 3o, Barcelona 08005 Barcelona (Barcelona).

      Once Tattoox receives the product and our staff verify and determine that the return conditions are met, Tattoox will refund the User all payments received, including shipping costs, within a maximum of fourteen (14) calendar days from the date on which the User informed Tattoox of their decision to withdraw from this contract. Tattoox will issue the refund using the same payment method used by the User for the initial transaction, unless the User states otherwise. The User will bear the return costs of the product purchased.

      Please note that the costs of returning products will be borne by you and that Tattoox will not in any case accept returns sent freight collect.

       

      12. Defective Products

      Tattoox guarantees that the product conforms to the characteristics indicated on the website and that it will be delivered in perfect condition. The User must also ensure that, once the order is received, they check that it is in perfect condition. Remember that you have 15 calendar days from receipt of the product at your address to request a return.

      Once our staff verifies that the product is indeed defective, a refund or replacement will be processed.

      A product will not be considered defective if more than 6 months have passed since its receipt, as it cannot be determined whether it has been misused.

      For this return to be effective, you must ensure that the product:

      • Has not been used
      • Has not been involved in any accident or damaged when attempting to repair it.
      • Has not been used contrary to what is set out by the seller.
      • Has not suffered damage due to wear, misuse or machine washing.

      If the above requirements are not met, and if the withdrawal period has elapsed at the time the return is made, Tattoox may, at its discretion, decide whether or not to proceed with the return.

      From the moment delivery takes place, the User will assume all risks that the product may suffer. Tattoox will not be responsible for what may occur once it has been delivered in perfect condition.

      Under no circumstances will a product be considered defective if it has been misused. We do not recommend using our products for any type of sports activity or machine-washing them, as they may deteriorate or break.       13. Complaints and Claims

      The Customer may address their complaints and claims to the email address info@tattoox.io.

      Tattoox must respond to complaints received as soon as possible and, in any case, within a maximum period of one month from the submission of the complaint.

      In accordance with EU Regulation 524/2013, the European Commission provides consumers and users with an online dispute resolution platform, available at the following link: http://ec.europa.eu/consumidores/odr/. Consumers may submit their claims through the online dispute resolution platform.


      14. Applicable Law and Jurisdiction

      These General Contracting Conditions shall be governed by and interpreted in accordance with Spanish law.

      Disputes that may arise between Tattoox and the User will be submitted to the Spanish Courts and Tribunals.

       

        Mobile Terms of Service

        The mobile messaging service of Tattoox (the "Service") is operated by Tattoox ("Tattoox", "we" or "us"). Your use of the Service constitutes your acceptance of these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without prior notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time; your continued use of the Service after the effective date of such changes will constitute your acceptance of them.

        Consent and Messaging

        By consenting to Tattoox’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Tattoox through your telephone provider to the mobile number you provided, even if your number is registered on any state or federal "Do Not Call" list. Text messages may be sent using an automatic telephone dialing system or other technology.

        -Service-related messages: These may include updates, alerts and information (for example, order updates, account alerts, etc.).

        -Promotional messages: These may include promotions, special offers and other marketing proposals (for example, abandoned cart reminders).

        You understand that registering for this program is not required to make purchases, and your consent is not a condition of any purchase with Tattoox. Your participation in this program is completely voluntary.

        Rates and Frequency

        We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your telephone provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your telephone provider for more details. You are solely responsible for all charges related to SMS/text messages, including charges from your telephone service provider.

        Cancellation (Opt-Out)

        You may opt out of the Service at any time. Text the keyword STOP to Tattoox or click the unsubscribe link (where available) in any text message to cancel. You will receive a one-time cancellation confirmation text message. No further messages will be sent to your mobile device unless you initiate them. If you have subscribed to other Tattoox mobile messaging programs and wish to cancel, unless otherwise required by applicable law, you must opt out of those programs separately by following the instructions provided in their respective mobile terms.

        Support and Changes to the Service

        For support or assistance with the Service, text the word HELP to Tattoox or email shop@tattoox.com.

        We may change any short code or telephone number we use to operate the Service at any time and will notify you of such changes. You acknowledge that any message, including STOP or HELP requests, that you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.

        Liability and Carriers

        The telephone carriers supported by the Service are not responsible for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you obtain a new mobile number, you must register for the program with your new number.

        To the extent permitted by applicable law, you agree that we will not be liable for the failed, delayed or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take based on the information or the Service.
